I don't care if you believe in the death penalty or not, but attempted murder (AM) and succesful murder (SM) should have the same exact punishment.

In AM, you had the same intention as in SM. You just epically failed. In SM, you had the same intentions as in AM. You just epically won.
Therefore you tried to do the same thing in each crime.

If you get a lesser punishment for AM, that means you just got lucky and the person didn't die (or unlucky depending on your moral compass.)
